Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Odyssea mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

The App is operated by Tatsapat Saerejittima, an independent developer based in Bangkok, Thailand ("we," "our," or "us").

2. Description of Service

Odyssea is a mobile application designed to help scuba divers:

Create and manage personalized dive certification cards
Log and track dive history
Store dive-related information and photos
Export and share dive logs and certification cards
Optionally sign in to sync and back up their data across devices
Optionally subscribe to Odyssea Pro for additional features (see Section 7)

The App is provided as a tool to complement your diving activities and record-keeping.

3. Important Safety Disclaimer

3.1 Not a Substitute for Official Certification

IMPORTANT: Odyssea-generated dive cards are for personal reference and convenience only. They are NOT:

Official replacement for certification cards issued by diving agencies (PADI, SSI, NAUI, etc.)
Valid proof of certification at dive centers, resorts, or shops
Legally recognized diving credentials
Substitutes for proper dive training and certification

3.2 Diving Safety

WARNING: Scuba diving involves inherent risks. By using this App, you acknowledge:

You are responsible for your own safety while diving
You will not dive beyond your training and certification level
You will always carry your official certification card when diving
The App is a record-keeping tool, not a safety device
Information in the App may be inaccurate, incomplete, or out of date
You will follow all established diving safety protocols and guidelines

3.3 Medical Fitness

You are responsible for ensuring you are medically fit to dive
The App does not provide medical advice or fitness assessments
Consult a physician before engaging in diving activities

3.4 Emergency Situations

The App is not designed for emergency use
In case of diving emergencies, contact emergency services immediately
Do not rely on the App for emergency contact information

3.5 Not a Dive Computer or Planning Tool

CRITICAL: Odyssea is a logbook and memory app, not a dive computer or dive-planning tool. You acknowledge and agree that:

The App does not calculate, monitor, or advise on decompression status, no-decompression limits, no-fly times, surface intervals, ascent rates, or gas consumption
Any such values shown in the App are values you entered or that were imported from a third-party dive computer; they may be wrong, incomplete, or out of date
You must never use the App to make any dive-planning or dive-safety decision
You will rely only on a certified dive computer, proper dive tables, your training, and qualified professionals for all dive planning, decompression, and flying-after-diving decisions

3.6 Reference Information

Dive-area, dive-site, and wildlife information shown in the App is provided for general reference only and may be inaccurate, incomplete, or out of date
It is not a substitute for local knowledge, official charts, briefings from a qualified dive operator, or your own assessment of conditions

4. User Responsibilities

4.1 Accurate Information

You are responsible for:

Entering accurate and truthful information into the App
Keeping your certification details current
Verifying all exported or shared information for accuracy
Maintaining your official certification records separately

4.2 Proper Use

You agree to:

Use the App only for lawful purposes
Not misrepresent your diving qualifications or certifications
Not use the App to create fraudulent certification documents
Not attempt to circumvent any security measures
Not reverse engineer, decompile, or disassemble the App

4.3 Age Requirements

You must be at least 16 years old to use the App. By using it, you confirm that you are 16 or older
If you are between 16 and the age of majority where you live, you must have parental or guardian consent
Parents/guardians are responsible for monitoring minors' use of the App

5. Intellectual Property

5.1 Ownership

Odyssea and all its original content, features, and functionality are owned by us
The App is protected by copyright, trademark, and other intellectual property laws
You may not copy, modify, distribute, or create derivative works without permission

5.2 Your Content

You retain ownership of all data you enter into the App
You grant us a limited, non-exclusive, worldwide licence to store, copy, process, and transmit your content solely as needed to provide the App to you: syncing and backing it up to your account, restoring it to your devices, and exporting or sharing it when you ask. This licence ends when you delete the content or your account, subject to the 30-day deletion window described in the Privacy Policy
You represent that you have the right to upload and share any content you add, including photos of other people

5.3 Certification Agency Trademarks

Certification agency names and logos (PADI, SSI, NAUI, etc.) are trademarks of their respective owners
Use of these names/logos in the App is for identification purposes only
We do not claim ownership or affiliation with any certification agencies unless explicitly stated

6. Privacy and Data

Your use of the App is also governed by our Privacy Policy, which forms part of these Terms
The App is offline-first: your data is stored locally on your device, and you can use the App without an account
If you create an account, your data is synchronized to and stored on our cloud servers so it is available across your devices
You can export or delete your data at any time, including deleting your account and server-side data
We do not sell your personal data. We share it only with the service providers needed to run the App (see the Privacy Policy)

7. Subscriptions and In-App Purchases

7.1 Odyssea Pro

Some features of the App ("Odyssea Pro") are available only with a paid subscription. The features included in Pro are described in the App at the time of purchase and may change over time
The core logbook, dive card, and trip features remain available without a subscription

7.2 Billing and Auto-Renewal

Subscriptions are purchased through, and billed by, the Apple App Store or Google Play ("the Store") under the Store's own terms. We do not process payments or store your payment details
The price and billing period (monthly or yearly) are shown in the App before you confirm the purchase. Payment is charged to your Store account at confirmation
Subscriptions renew automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your Store account is charged for renewal within 24 hours before the end of the current period
Where a free trial or introductory price is offered, its length and the price after it ends are shown before you subscribe. Any unused portion of a free trial is forfeited when you purchase a subscription

7.3 Managing and Cancelling

You can manage or cancel your subscription at any time in your Store account settings (Apple ID > Subscriptions, or Google Play > Payments & subscriptions). Deleting the App does not cancel a subscription
Cancellation takes effect at the end of the current billing period; you keep Pro access until then. We do not provide refunds or credits for partial periods, except where required by law
Refund requests are handled by the Store under its refund policy, as we cannot issue refunds for Store purchases

7.4 Price Changes and Availability

We may change subscription prices for future billing periods. The Store will notify you in advance and, where required, ask for your consent before a new price applies
Pro entitlement is tied to your Store account and, when signed in, to your Odyssea account. Use "Restore Purchases" in the App to re-activate Pro on a new device
If we discontinue Odyssea Pro or a Pro feature, we will give reasonable notice and will not charge you for renewals after discontinuation

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability, fitness for a particular purpose, or non-infringement
Accuracy, reliability, or completeness of information
Uninterrupted or error-free operation
Freedom from viruses or harmful components
Suitability for professional or commercial use

USE THE APP AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for any direct, indirect, incidental, consequential, or special damages
This includes damages for diving accidents, injuries, death, loss of data, or loss of profit
Our total liability shall not exceed the amount you paid for the App (if any) in the 12 months before the claim

SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify, defend, and hold harmless Odyssea and its developers from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms
Your violation of any third-party rights
Any diving-related incidents or accidents

11. Third-Party Services and Links

The App may contain links to third-party websites or services
We are not responsible for the content, privacy policies, or practices of third parties
Use of third-party services is at your own risk

12. Modifications to the App and Terms

12.1 App Changes

We reserve the right to:

Modify, suspend, or discontinue the App at any time
Add or remove features
We will notify you of significant changes

12.2 Terms Changes

We may update these Terms from time to time
Continued use after changes constitutes acceptance
Material changes will require your explicit consent

13. Termination

13.1 By You

You may stop using the App and delete it at any time
Deleting the App removes all local data on that device
To remove your account and server-side data, use Settings > Account > Delete Account in the App or contact us (see Section 16). Deleting the App alone does not delete your account or cancel a subscription

13.2 By Us

We may terminate or suspend your access if:

You violate these Terms
You use the App for illegal or fraudulent purposes
We discontinue the App

13.3 Effect of Termination

Upon termination, your right to use the App ceases immediately
You must delete the App and all copies
Provisions that should survive (liability, indemnification) remain in effect

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the Kingdom of Thailand
Disputes will be resolved in the courts of Thailand

14.2 Informal Resolution First

Before starting any court proceeding, you agree to contact us at the address in Section 16 and give us 30 days to try to resolve the dispute informally
Nothing in these Terms removes any consumer-protection rights you have under the mandatory laws of the country where you live

14.3 Exceptions

Either party may seek injunctive relief in court for intellectual property violations

15. Miscellaneous

15.1 Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the App
They supersede all prior agreements or understandings

15.2 Severability

If any provision is found invalid, the remaining provisions remain in effect

15.3 Waiver

Failure to enforce any right does not constitute a waiver

15.4 Assignment

You may not assign these Terms without our consent
We may assign our rights and obligations to any party

15.5 No Agency

These Terms do not create a partnership, agency, or employment relationship

15.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control

17. Acknowledgment

BY USING ODYSSEA, YOU ACKNOWLEDGE THAT:

You have read and understood these Terms
You agree to be bound by these Terms
Odyssea Pro subscriptions renew automatically until cancelled in your Store account
Odyssea is for personal record-keeping only
The App is not a substitute for official certification cards
You are responsible for your own diving safety
Scuba diving involves inherent risks
You will always carry official certification when diving
You use the App at your own risk

18. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply. In the event of any conflict, this section controls for App Store editions of the App:

Acknowledgement: These Terms are between you and us (the developer) only, not with Apple. Apple is not responsible for the App or its content.
Scope of License: Your license to use the App is a non-transferable license to use it on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
Maintenance and Support: We are solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
Warranty: We are solely responsible for any product warranties, whether express or implied. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
Product Claims: We, not Apple, are responsible for addressing any claims relating to the App, including product liability, failure to conform to legal or regulatory requirements, consumer protection claims, and claims that the App infringes a third party's intellectual property rights.
Legal Compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
Third-Party Beneficiary: You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
